Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following Terms and Conditions of use, which together with our Privacy Policy govern Inverarity Morton’s relationship with you in relation to this website. If you disagree with any part of these Terms and Conditions, please do not use our website. These terms were last updated on 21/04/21 as part of the website launch.

The term ‘Inverarity Morton’ or ‘us’ or ‘we’ refers to the owner of the website, William Morton Limited, whose registered office is 7 Evanton Drive, Thornliebank Industrial Estate, Glasgow G46 8HL. Our company registration number is SC056257. The term ‘you’ or ‘customer’ refers to the user or viewer of our website.

The use of this website is subject to the following Terms of Use and these Terms will apply to every contract between us for the sale of goods to you. This is true whether that Contract is finalised using our website, over the telephone, through e-mail or other written correspondence or otherwise, and wherever in the world you reside and/or place the order.


1.1 – Warranties and Contract

  1. We warrant that the wines will be of satisfactory quality and fit for their general purpose.
  2. The placing of an order anywhere on our Sites does not constitute a contract. Order acceptance and the completion of the contract between you and us will take place on the despatch of the goods ordered. This is true unless we have notified you that we do not accept your order or you have cancelled your order in line with our cancellation policy.
  3. Your ownership of the goods will commence on delivery of the goods, provided that we have received payment in full for the goods.
  4. Relevant United Kingdom law will apply to these terms and conditions and the relevant courts of the United Kingdom will have exclusive jurisdiction. Our details are above should you want to contact us.
  5. We reserve the right not to accept any order. The circumstances in which we may not accept an order include, but are not limited to: 
    1. The goods you ordered being unavailable. Our website checks stock against our warehouse stock at the time of purchase so cannot be fully guaranteed as being accurate in all circumstances.
    2. Your payment not being successfully authorised
    3. The identification of a pricing or product description error
    4. Failure to verify that you are over 18 years of age


A summary of your key legal rights as a consumer in relation to the Product is set out  below. Paragraph 4 below includes information about changes to Products which may be made from time to time.

Summary of your key legal rights

The Consumer Rights Act 2015 requires that any Product which you order from us must be as described, that it must be fit for purpose and that it must be of satisfactory quality. During the expected life of a Product which you order your legal rights entitle you to the following:

  • up to 30 days: if your Product is faulty, then you can get a refund if you return the Product to us;
  • up to six months: if your Product is faulty and cannot be replaced, then you’re entitled to a full refund in most cases if you return the Product to us; and
  • up to six years: if the Product can be expected to last up to six years but develops a fault before then, you may be entitled to a replacement if you return the Product to us or, in circumstances where that is not available, some of your money back.

This is a basic summary of your key legal rights. These rights are subject to certain exceptions. For detailed, independent advice about your legal rights (in the United Kingdom) please refer to the Citizens Advice website: adviceguide.org.uk.

  1. All prices are quoted in pounds sterling, and may be per product or per case, as marked. The prices include UK duty and VAT, unless otherwise specified. Any delivery charges are additional, unless otherwise specified.
  2. The price of a Product does not include delivery charges. Our delivery charges are explained to you during the check-out process, before you confirm your order. To check relevant delivery charges, please refer to paragraph 13 -  Delivery Charges.
  3. Payment for the Product and all applicable delivery charges is in advance. We reserve the right to end the Contract immediately if payment using the card details which you provide fails.
  4. You can pay for a Product using any of the payment methods listed at the payment stage of the checkout process.
  5. We reserve the right to terminate any special offer at any time, without notice.
  6. The price for each Product will change from time to time, but changes will not affect any order you have already placed.
  7. We endeavour to ensure that all pricing information on our site is accurate. However, errors do occasionally occur and products may consequently be incorrectly priced. In the event that a product you have ordered is listed at an incorrect price we will contact you before dispatching your goods and ask you to confirm if you wish to proceed with your order at the correct price or if you wish to cancel your order. If you do not confirm that you wish to proceed with the order within seven days of the date of our making contact with you, this will be treated as your instruction to cancel.
  8. We will not be obliged to supply goods at the incorrect price.
  9. We reserve the right to change prices at any time. Such cases include but are not limited to:
    1. In the event of major currency fluctuations
    2. Changes in the rate of HMRC Excise Duty
    3. Changes in the rate of VAT
    4. Changes in the rate of other taxes or import tariffs (including but not limited to the imposition of any new or replacement duty or tariff by the WTO or any other competent authority domestic or international
    5. Changes in other market conditions
  10. Promotional offers and prices are as stated, with no further discounts available. We also reserve the right to terminate any special offer at any time, without notice.
  1. Please note that in Scotland and Wales, alcohol sales are further governed by:
    1. Scotland: Alcohol Scotland Act 2010
    2. Wales: Public Health (Minimum Price for Alcohol) (Wales) Act 2018
  2. Therefore our prices in Scotland may operate differently than in England and Wales. The Alcohol Scotland Act 2010 disallows any alcohol promotion offering customers a discount for buying multiple products in Scottish stores whilst the Alcohol (Minimum Pricing) (Scotland) Act 2012 sets a minimum price of 50 pence per unit for all alcoholic beverages sold in Scotland.

4.1 – Availability & Substitutions

  1. Wine is a Fast Moving Consumer Goods (FMCG) product and we cannot guarantee always having stock of particular wines with particular attributes i.e. labels, vintages etc. If you order a case of wine and some of the products are out of stock we will replace them with equal or higher value wines.
  2. Occasionally we have to substitute wines for another vintage or an alternative wine of equal or greater value. If you are unhappy with any substitutions you receive we will arrange collection at our cost.
  3. When opting for substitutions, this means when a product within an order is unavailable, we shall replace it with a similar product of equal or higher value.

4.2 – Product

  1. The images of each Product on our website are for illustration purposes only. Although we have made reasonable efforts to display the appearance of each Product accurately, we cannot guarantee that your computer’s display will accurately reflect the appearance of that Product.
  2. Even a Product which is pictured on our website with Product-specific outer packaging may not be available with that packaging, as our suppliers do not always include Product-specific outer packaging when delivering a Product to us, and because the specifications of a Product may change from time to time. If you want to receive Product-specific outer packaging together with any Product which you order, please contact us before you place your order so that we can check whether that Product is available with Product-specific outer packaging.
  3. The tasting notes on our website are written in-house by our own wine-loving team. Wine tasting is subjective and people will have different opinions so therefore the tasting notes do not form part of the description of any Product.
  1. It is against the law for any person under the age of 18 to buy, or attempt to buy intoxicating liquor or for any person over the age of 18 to buy or attempt to buy intoxicating liquor for any person underthe age of 18. We will not sell wine to anyone who isn't 18 years old or over.
  2. By placing an order you also confirm that you are at least 18 years old.
  3. If you are buying a case of wine as a gift - the recipient must also be over 18 years old. By placing an order you confirm that you and the recipient of the wine are at least 18 years old.
  4. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the wine is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the wine.
  5. We will validate name, address, age and other personal information supplied by you during the order process against appropriate third party databases. By accepting these Terms and Conditions you consent to such checks being made.
  6. We reserve the right not to deliver if we are unsure of you or the recipient’s age being greater than 18 years.
  1. All information (including credit card details) is sent and received using up-to-date secure e-commerce software. We use secure servers with state-of-the-art encryption and secure sockets layer (SSL) technology for the transfer of credit card information.

  3. Additionally, we have security measures in place to protect our customer database and access to this database is restricted internally.
  4. By registering for an account you agree that: The personal information that you are required to provide when you register as a customer is true, accurate, current and complete in all respects. you will notify us immediately of any changes to the personal information by updating your details within the “My Account” section within your online account or by contacting us using the contact details below. If we suspect that any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your use of the Sites or your account.
  5. It is your responsibility to protect your password from being disclosed to any third party.
  6. We reserve the right to suspend your use of our site at any time for operational, regulatory, legal or other reasons. We may terminate your use of the Sites and/or your account with us with immediate effect if you breach any of these Terms.
  7. To help to ensure that your credit or debit card is not being used without your consent, we may validate name, address and other personal information supplied by you during the order process against appropriate third party databases.

We continually strive to achieve customer satisfaction - If for any reason you are unhappy with our performance, please contact our customer services department immediately using the form on the Contact Us page.

  1. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a resolution has been achieved.
  2. Incorrect/missing or damaged products:
    1. In the event that any of the products in your order are incorrect, missing, or damaged, please let us know within 7 days.
    2. Where the order is a single product item we will collect the item, unless we agree otherwise, and then once we have confirmed receipt of that item we will send the correct replacement free of charge. Delivery of the replacement product should take place within 7 working days of you notifying us regarding the incorrect item.

8.1 Cancellations

  1. We will provide a full refund or replacement for any wines that are faulty. This does not affect your statutory rights.
  2. So long as all of the products have not been opened and are intact, you may cancel your order for any reason whatsoever at any time up to 14 working days from the day after the date you receive your wine
  3. Please let us know if you wish to cancel an order by contacting our Customer Services team using the form in the Contact Us page or email support@inveraritymorton.com . If you are e-mailing us or writing to us please include details of your order to help us identify it.
  4. It is your responsibility to hold onto the wine and take reasonable care of it until we come to collect it. Once we have confirmation the case is collected we shall reimburse the price of the wine within 10 working days.
  5. Any products collected by our carrier must be in their original box to avoid further breakages, where possible. If the packaging has become damaged or weakened the courier will not accept the package. Please contact our Customer Services team using the form in the Contact Us page or email support@inveraritymorton.com before requesting a collection.
  6. All refunds given will be made by the same payment method you originally used to make payment.
  7. Any refund which we make will be on the condition that you return the Product to us, unless we agree otherwise, and that we do actually receive the Product back from you.
  8. You must return a Product to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Contract. You must send the Product back to us at the address above.
  9. If we make a refund to you and later discover that you have not returned the Product to us, or that you have handled it in an unacceptable way or that it has been damaged by you or by your carrier when it is being returned to us, we may ask you to pay us an appropriate amount. We will agree that amount, acting reasonably, in conjunction with you.
  10. If you subsequently receive your order after cancelling it and getting a refund, you must let us know and allow us to collect the products you have received.

8.2 Returns

  1. If you don't enjoy any of the wines or suspect that they may be faulty please contact our Customer Services team using one of the methods in the Contact Us page and one of our advisers will be more than happy to assist.
  2. If a bottle of wine is corked, oxidised or appears otherwise out of condition, provided it is still within the recommended drink date and has been stored in suitable conditions, we will arrange to replace the faulty bottle with a bottle of the same type of wine (or if not available, a bottle of another type of wine which is of equivalent value). Alternatively if you prefer we will refund you an amount equal to the value of the bottle. We reserve the right to ask you to provide evidence of the fault and/or to collect the faulty bottle for inspection (at our cost).
  3. If you change your mind you have a legal right to cancel any Contract during the period set out in paragraph 8.1.2 above. This means that if, during the relevant period, you change your mind, you can cancel the Contract and receive a refund.
  1. Nothing in these Terms and Conditions shall affect our liability for death or personal injury arising from our negligence, for fraud, or any other liability which cannot be excluded or limited under applicable law.
  2. Our liability for any losses, damage or costs you suffer as a result of us failing to comply with these Terms and Conditions is strictly limited to any losses, damage or costs which are a foreseeable consequence of such failure.
  3. We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where: 
    1. loss or damage was not foreseeable to both parties when the contract was formed;
    2. loss or damage was not caused by any breach on the part of the supplier;
    3. loss or damage relates to business and/or non-consumers.
  4. Loss, damage or a cost is foreseeable if either it is obvious that it will happen, or if, at the time the contract was made, both we and you knew it might happen.
  5. We will not be liable to you or to any third party for any loss, damage or costs which arise as a result of:
    1. your failure to lift, transport, store or otherwise handle any product in an appropriate and safe manner; or
    2. your failure to comply with the recommendations set out in Paragraph 10 “Alcohol and other Warnings” section below.
    3. Any spillages or breakages involving one or more of our products, unless such loss, damage or cost arises as a result of our negligence or one of our products being faulty or defective.
  6. We are not responsible for any delay in, or failure of, performance of our obligations under these Terms and Conditions arising from any event which is outside of our control (for example, an act of God, governmental act, war, fire, adverse weather conditions including snow, flood or storm, explosion or civil commotion, failure of a third party (other than our sub-contractors) or in information technology or telecommunications services, or industrial action). In the event of a significant delay or failure, we will contact you and take reasonable steps to minimise the effect of the delay or failure. If you are unhappy with a delay which affects your order, you may cancel the order and receive a refund for any products you have paid for but not received.

Customers should also be aware of the following inherent risks and warnings:

  1. Alcohol should be consumed in moderation.
  2. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
  3. Red wine in particular may cause staining if spilt so extra care should be taken.
  4. Sparkling wines and champagnes can be volatile due to the build-up of gases, extra care should be taken when opening these.
  5. Where possible, you should store bottles horizontally, at a stable, cool temperature, out of direct light and in an atmosphere which has some moisture in order to avoid the drying out of corks. The wine should be subject to as little movement as possible.
  6. Some of the Products contain warnings about the way in which they are to be used, and by whom they are to be used. We are not responsible for any loss or damage which is caused as result of you ignoring any Product warnings which are reasonably obvious upon an examination of the Product.

  2. You must obtain our prior written consent before you use our website or any part of it in any other manner.
  3. You agree and acknowledge that we own or are licensed to use all copyright, database rights, trademarks, and other intellectual property rights in and to all parts of this web site, and to the business of William Morton Limited, the structure, design, and layout of the web site and the styles of the wines.
  1. Where we deliver: We will deliver your wine to anywhere in the United Kingdom except for the Channel Islands, Isle of Man and Northern Ireland
  2. Delivery timescales:
    1. Standard delivery - Our delivery is £6.00 per order to a single address. Standard delivery is a 3-5 working day service for all orders. However there are a few exceptions which are shown in paragraphs 13.3a, 13.3b and 13.3c below.
    2. Please note that at certain times (such as Christmas) the cut-off time required for delivery may change. Any changes will be shown on the website.
  3. Delivery timescale exceptions:
    1. Please allow at least 72 hours for delivery to: Scotland and Scottish Isles: AB30-31, 33-38, 41-45, 51-56, 63; DD8-10; FK1, 3, 8, 17-21, HS1-9; IV21; IV1-11, 10-28, 30-32, 36, 40-56, 63; KA27-28; KW1-3, 5-17; PA20-49, 49-88; PH10-11, 13-26, 30-44, 49, 50; PA44; PH41-44, TR21-25; ZE1-3
    2. Unfortunately, we cannot offer a delivery service to the Scottish Highlands over the weekend. Orders to these areas that are placed after 4pm Thursday may not be scheduled for delivery until the start of the next week depending on your postcode. Please use the form on the Contact Us page for further clarity if this may impact your order.
    3. We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications provider in connection with the performance of this Agreement.
  4. Our deliveries are made by third party carriers. Some standard deliveries do not require a signature; however, we require that any order of £500 or more must be signed for (even if you select alternative delivery instructions when placing the order). If you are out, the delivery driver may be able to leave your order for you in accordance with the instructions that you gave us when you placed your order, for example, in a safe place (except any order of £500 or more) or to a neighbouring address and if this is not possible, a card will be posted through your letterbox with instructions on how to arrange re-delivery. You should keep your delivery note and all packaging and should notify us immediately if any of the order is missing or damaged. If your order is £500 or more, and therefore a signature is required, please ensure that you are available to sign for the delivery.
  5. We do not accept any responsibility for delayed or failed delivery of a Product that results from your failure to provide correct address information. If a Product is returned to us because you fail to provide correct address information, we reserve the right to require that you pay additional postage costs (and import duties, administration fees and taxes, if applicable) before we re-deliver the Product. Please also refer to Paragraph 13.6 below in this regard.
  6. The costs of delivery will be displayed to you on our website. Our designated courier will give you an estimated delivery date through their electronic communication with you. Occasionally our delivery to you may be affected by an Event Outside Our Control. See paragraph 16.2 below for our responsibilities when this happens.
  7. If no one is available at your address to take delivery and you give us no other instructions at the time of placing your order, our carriers will usually:
    1. leave your parcel in a safe place;
    2. leave your parcel with a neighbour; or
    3. leave you a note which informs you that they have attempted to deliver the Product. If this happens, please follow the carrier's instructions as to how to re-arrange delivery.
  8. Delivery of an order shall be completed when:
    1. our carrier delivers the Product using one of the methods referred to in paragraph 13.2 above; or
    2. you (or someone else on your behalf) collect(s) the Product from our carrier's depot, and the Product will be your responsibility from that time. If you are informed about a failed delivery attempt but do not re-arrange delivery of a Product or collect that Product from the carrier’s depot we (or the carrier) will contact you for further instructions and we may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the Contract.
  9. You own the Products once we have received payment in full, including all applicable delivery charges, value-added taxes, import/administration charges which are payable by us.
  1. Wines purchased from us are for the customer's own use only (which may include their use as gifts for third parties). Wines may not be re-sold or otherwise used for commercial purposes.
  2. If you are a corporate partner or would like to hear about corporate partner opportunities, please contact us.
  3. The Terms set out on this page apply only if you are a consumer. They do not apply if you are acting as a trade customer (in other words, if you are a business which is purchasing goods from us, regardless of whether you are registered with us as a trade customer). 
  4. As you are a consumer (that is to say that you enter this contract otherwise than in the course of your trade or business), we are under a legal duty to supply a Product that is in conformity with this Contract. As a consumer, you have legal rights in relation to a Product that is faulty or not as described. These legal rights are not affected by your right of return and refund in paragraph 8.1.2 or anything else in these Terms.

  6. We only supply goods for domestic and private use. you agree not to use the goods for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  1. For the purposes of the prevention or detection of offences, and/or the apprehension or prosecution of offenders, we may share any information that we collect with the Police, other public or private sector agencies or representative bodies in accordance with the relevant legislation. Information shared in this way will not be used for marketing purposes.
  2. We reserve the right to cancel an order, end a Contract, refuse to deliver a Product and inform law enforcement agencies in circumstances where we consider (acting in our absolute discretion) that you are attempting to obtain a Product using fraudulent means, to commit any other type of fraud or to otherwise break the law.

16.1 - Our right to vary these Terms

  1. We amend these Terms from time to time. Please look at the top of this page to see when these Terms were last updated and why.
  2. Every time you order a Product from us, the Terms in force at the time of your order will apply to the Contract between you and us.
  3. We may revise these Terms as they apply to your order from time to time to reflect the following circumstances:
    1. changes in relevant laws and regulatory requirements; and
    2. changes in the way that we do business.
  4. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.


16.2 - Events Outside Our Control

  1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined in paragraph 16.2.2 below.
  2. An Event Outside Our Control means any act or event beyond our reasonable control, including (without limitation) failure or breach of contract by a carrier or other sub-contractor, strikes or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  3. If an Event Outside Our Control that affects the performance of our obligations under a Contract takes place:
    1. we will contact you as soon as reasonably possible to notify you;
    2. we will take steps to minimise the effect of that Event Outside Our Control; and
    3. our obligations under the Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of a Product to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
  4. You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any Product you have already received and we will refund the price you have paid, including any delivery charges.
  5. References in this paragraph (16.2) to an Event Outside Our Control do not include any action which you take in order to frustrate or hinder our performance of the Contract. If we consider, acting reasonably, that you are intending to frustrate or hinder our performance of the Contract (or that you have frustrated or hindered that performance), we may (though are not required to) treat the order as cancelled, end the Contract and notify you in writing.
